Introduction

This Privacy Policy applies to all website and mobile applications, services, products, and content linking to or posting this Privacy Policy that are operated by LegalFix, LLC (LegalFix, we, our, us)—which are collectively referred to in this Privacy Policy as the LegalFix Services or the Site.

In this Privacy Policy, we describe our practices for collecting, storing, using, and disclosing the personal and other information that we may obtain about you (you, user, lawyer-user, consumer-user) through the Site, or through your other communications with us. Please note that by using or accessing the Site, or communicating with us by telephone, mail, e-mail, chat messaging, or otherwise, you consent to the collection, storage, use, and disclosure practices regarding your personal and other information, as described in this Privacy Policy.

Information We Collect

We collect information about you that you provide to LegalFix; that we receive from third-party sources; and that we receive through automated technologies.

The information we collect includes:

  • Personal Information
    LegalFix requires each registered user to provide us with personal information (Personally Identifiable Information or PII) to access and use the LegalFix Services. Personally Identifiable Information is captured when a user registers for a free account or other registered use of the LegalFix Services and when a registered user accesses the LegalFix Services or communicates with us by e-mail, telephone, chat messaging, or other means.
    Personally Identifiable Information may also be captured when a lawyer-user creates a professional profile on the Site; publishes content or information on the LegalFix Services (Quick Summaries, Ask a Lawyer answers or comments, recommendations requested or received); or participates in surveys, forums, reviews, feedback submissions, product testing, and other aspects of the LegalFix Services.
    Similarly, Personally Identifiable Information may also be captured when a consumer-user posts a question or comment in our public Ask a Lawyer forum; searches for a lawyer using our Find a Lawyer feature; or participates in surveys, forums, reviews, feedback submissions, product testing, and other aspects of the LegalFix Services.
    Personally Identifiable Information includes: (i) Contact Data, such as your name, address, telephone number, e-mail address, city, state, and zip code; (ii) Demographic Data, such as your zip code, age, and gender; and (iii) any profile picture you upload to the Site.
    Court opinions—also known as cases, case law, judicial opinions, or common law—are documents created by federal and state employees (judges) and are in the public domain. There are millions of court opinions in the LegalFix Services database, and they comprise an important part of American law. If you were a party to a case or otherwise involved in a case in a jurisdiction included in our database, your name and the related case may appear in search results on our Site.
    Court opinions and other primary legal materials (statutes, rules, regulations, administrative rulings, public ordinances) are public domain documents and are not subject to takedown requests. LegalFix does not remove court opinions from our free public database of law unless they have been sealed by a court order.
    If you find a sealed case in our database, please contact us at privacy@LegalFix.com and include your name; your e-mail address; a link to the case; and the court order sealing the case.
    And if you would like to request the removal of a non-sealed case from external search engine results (Google), please e-mail us at privacy@LegalFix.com, and include your name; your e-mail address; a link to the court opinion; and a statement of why you believe the court opinion should be removed from external search engine results.
    LegalFix may, in our sole discretion, respond to such a request, or take action to attempt to remove such a court opinion from public search engine results, but you understand and agree that we are under no obligation to do so.

  • User Data
    LegalFix may collect various types of use data and traffic data when you use or access the Site, including your IP address (Internet Protocol); your mobile device identifier; your internet service provider (ISP); the web page you visit before visiting the Site (referring page); the last page you visit on the Site (exit page); your operating system; your browser type; clickstream data; date and time stamps; items you click on; pages you view; amount of time you spend on particular pages; search terms you submit to the Site; metadata related to files you upload to the Site; and questions, comments, and information you send to our customer support (collectively, User Data).
    Our servers and software automatically recognize User Data. We may use User Data to compile traffic data about the types of users who use the Site at specific intervals (Traffic Data). We may use Traffic Data to analyze Site traffic, but this information is not examined for Personally Identifiable Information. We may also use Traffic Data to diagnose problems with our server, administer our Site, or display content according to your preferences. User Data and Traffic Data may also be shared with our business partners, affiliates, or advertisers on an aggregated and anonymous basis.

  • Cookies and Similar Technologies.
    LegalFix and its partners may use the standard cookie feature of leading browser applications and third-party providers, including Google Analytics features (Remarketing, Google Display Network Impression Reporting, the DoubleClick Campaign Manager Integration, and Google Analytics Demographics and Interest Reporting), or use internally-developed cookies and tracking codes that allow us to store a small piece of data on a user’s computer (or any other device used to access the Site) to recognize the user and retain information regarding the user’s preferences and use of the Site, or use of other plug-ins exchanging information with the Site.
    For example, if you have chosen to allow Google to associate your web and app browsing history with your Google account, and to use information from your Google account to personalize ads, Google will use data from you while signed-in to your Google account (Personally Identifiable Information)—together with Google Analytics advertising cookies and identifiers—to tailor ads to your indicated preferences, across your devices.
    We do not share information that personally identifies you (information such as your name or e-mail address that can by itself be used to contact or identify you) with advertising measurement or analytics partners unless you give us permission. We may provide these partners with information about the reach and effectiveness of their advertising without providing information that personally identifies you, or if we have aggregated the information so that it does not personally identify you.
    You may opt-out of Google Analytics by following Google’s opt-out instructions.
    We may use similar technologies, such as java scripts and etags, to analyze trends, administer the Site, track users’ movements on the Site, and gather demographic information about our user base in the aggregate.
    You can remove persistent cookies by following the directions provided in your internet browser’s help directory. If you reject cookies, you may still use the Site, but your ability to use some aspects of the Site will be limited.

  • Web Beacons.
    We may use a software technology called clear gifs (or web beacons) to help us track referrals from our partners and affiliates and to better manage the Site. Clear gifs are tiny graphics with a unique identifier and are similar in function to cookies—they are used to track the online movements of web users.
    Cookies are stored on a visitor’s computer hard drive, and clear gifs are embedded invisibly on web pages. But we do not tie the information gathered by clear gifs to your Personally Identifiable Information.

  • Third Party Tracking.
    Our service providers, technology partners, and other third-party entities (including social media links) may use cookies, clear gifs, images, and scripts to help them manage their content on our Site.
    We do not have access or control over these technologies and their use is not covered by our Privacy Policy. But we do not tie the information gathered by these third parties to the Personally Identifiable Information of our users.

  • Lawyer Content and Consumer Content
    The LegalFix Services is a free public resource that includes summaries of legal topics written by lawyers and by LegalFix (Quick Summaries); questions asked by consumer-users in our public Ask a Lawyer forum; answers provided by lawyer-users in our public Ask a Lawyer forum; biographical information provided by lawyers on their profile pages; and recommendations of lawyers on the Site written by other lawyers on the Site.
    You understand and agree that any of this Lawyer Content or Consumer Content or other information you publish to the Site may be read, collected, shared, distributed, and used by others who access the Site—including by members of the public who are not registered users of the Site.
    This Lawyer Content and Consumer Content may also appear in search results when a person uses a search engine such as Google to search for information on the internet. And metadata about any such content you post on the Site may be visible to the public, along with your name.
    Your content—Original Lawyer Content, Republished Lawyer Content, and Consumer Content—are defined in and governed by our Terms of Service.
    If you are a registered lawyer-user, your professional status, uploaded profile picture (if any), and contact information (name, address, phone number, e-mail address, and law firm or other employer) you provide us may also be publicly visible. This information will be searchable online and may be reused or modified elsewhere.
    For more information, please see our Terms of Service—and particularly the sections titled “Publishing and Sharing Content on LegalFix” and “Ownership of Virtual Property.”
    If you are a lawyer-user, we may aggregate and display information in your profile about your publicly visible activities on the LegalFix Services, which will also be visible to the public. For example, your profile may include Quick Summary articles, commentary, guidelines, answers, checklists, services, and other content you have contributed to the LegalFix Services.
    If you are a lawyer-user your profile may also include a picture you upload, indicators, rankings, ratings, testimonials, and recommendations related to your professional reputation, status, performance, answers, or comments, and the quality and usefulness of your published content (Original Lawyer Content and Republished Lawyer Content) (collectively, Virtual Property)—as well as analytics and metrics associated with your publication of such content, and the responses, reviews, upvotes, rankings, and pageviews by other users of the LegalFix Services. Virtual Property does not include your Original Lawyer Content or Republished Lawyer Content, such as Quick Summaries you write and publish on the Site.

  • Electronic Communications.
    In the regular course of our business, we may monitor and record, log, or save e-mail communications, instant messaging/chat communications, and other communications between you and our employees, agents, or contractors for training and quality assurance purposes. And we may receive a confirmation when you open or click on content in e-mail communications, which helps us make our communications to you more useful and interesting.
    If you do not wish to receive commercial (promotional) e-mail messages from us, you may unsubscribe from our mailing list by using the Unsubscribe link on any of the e-mails we send or change your preferences on your Account Management page.

  • Law Student Ambassador Program.
    If you apply for the LegalFix Law Student Ambassador Program (or one of our other programs), you may be asked to provide certain Personally Identifiable Information such as your name, e-mail address, mailing address, telephone number, law school, date of birth, and age. You may also be asked to create a username and password.
    If you register for one of our programs, you agree to be contacted by us in connection with such program(s), using any such Personally Identifiable Information you provide.

  • Content, Sweepstakes, and Other Promotions
    We may collect information about you when you participate in a promotion that we sponsor, such as a contest or sweepstakes, which we may sponsor alone, or co-sponsor with one or more third parties. To participate in one of our promotions, you may be asked to provide your name, e-mail address, mailing address, telephone number, and other contact information.
    For some promotions, we may request other information about you as well. Your participation will be subject to the official rules of the promotion, as well as this Privacy Policy, and the privacy policy of any co-sponsor.

  • Interactive Forums.
    Consumer-users may post questions and follow-up comments in our public Ask a Lawyer forum, and lawyer-users may post answers and comments in our public Ask a Lawyer forum. We may collect any information you post on the Site—including personal information about you—and it may be available or visible to the public, including in internet search results. Please keep this in mind when considering what information to post to the Site.

  • Social Networking Activities.
    The Site may include the ability for you and other users to link to one or more social networking platforms (such as LinkedIn, Facebook, or Twitter). We may receive information about you when you choose to post or otherwise share information about us on any of these social networking platforms. Any information that you or others post to a social networking platform will be accessible by any users of the platform, subject to its terms of service and privacy policy.

  • Social Sign In.
    The Site may incorporate functionality enabling you to sign in using your login information from a social networking or other platform (Facebook, Google) in lieu of creating a new login account specifically for the Site. If you use such functionality to sign into the Site, we may collect information about you from the social networking or other platform, such as your list of friends, "likes," and interests, as well as your contact information.

  • Third-Party Integrated Services.

    Except as otherwise described in this Privacy Policy, any information collected through such integrated technologies is collected directly by these third parties for use by such third parties and other authorized parties, subject to the privacy policies of those other parties.

  • Online Inquiries and Communications.
    When you submit an inquiry or otherwise communicate through the Site, you may be asked to provide your name, e-mail address, and other personal information to us. In the regular course of our business, we may monitor, record, log, and save such Personally Identifiable Information, and your related communications with us.

  • Live Chat
    When you communicate with us online through the Live Chat interface, we collect these communications for customer service, processing personal information requests, compliance records, and training purposes.

  • Reverse Append
    We may collect your e-mail address via cookies and pixels on the Site using trusted service providers. These service providers may combine your e-mail information with other information they have access to such as your mailing address so that we may serve relevant marketing offers to you via direct mail.

We may keep the information we collect about you indefinitely.

How We Use Information We collect

We do not sell your personal information. But we may use information we collect to (i) communicate with you about the LegalFix Services and any programs you apply for, such as the Law Student Ambassador Program; (ii) process your account registration; (iii) provide you with information related to your use of the Site, such as when a consumer-user posts a question in the public Ask a Lawyer forum and when a lawyer-user is subscribed to receive notice of such posted questions; and (iv) provide you with information related to your account with LegalFix.

For example, you may receive a welcome e-mail to confirm your e-mail address, username, and password. You may also receive communications responding to your inquiries; providing or facilitating services you request; and managing your account. We may also send service-related announcements—for example, to alert you if we need to temporarily suspend the Site for maintenance.

We occasionally send commercial (promotional) e-mail messages to registered users of the LegalFix Services and to those who have opted-in to receive such e-mail messages. You can opt-out of these commercial e-mail messages by using the Unsubscribe link and following the unsubscribe instructions in the e-mail or other electronic communication—or by e-mailing us at privacy@LegalFix.com or changing your preferences on your Account Management page.

But you generally may not opt-out of transactional or relationship messages related to your account and our delivery of the LegalFix Services, as they are not commercial (promotional) messages. If you do not wish to receive such transactional or relationship messages from us, you may terminate your account on your Account Management page.

You may choose not to provide LegalFix with Personally Identifiable Information, or to turn off cookies in your browser settings. If you make these choices, you may continue to browse the Site and use the LegalFix Services available to unregistered users—but you cannot use the LegalFix Services for which registration is required without providing us with your Personally Identifiable Information.

We may provide you the opportunity to participate in surveys and product testing to measure customer satisfaction and to receive feedback on new products and features. If you choose to participate, we may request certain Personally Identifiable Information from you. Your participation in these surveys, product tests, sweepstakes, or contests we offer is voluntary and you may choose to participate and disclose such information or choose not to participate.

The requested information for such surveys, product testing, sweepstakes, and contests typically includes your name, e-mail address, and mailing address. We use this information to communicate with you about survey responses; to notify contest winners; to award prizes; to monitor Site traffic; and to personalize the Site.

We may use a third-party service provider to conduct these surveys or contests, and that service provider will be prohibited from using your Personally Identifiable Information for any other purpose. We will not share the Personally Identifiable Information you provide through a survey or contest unless we give you prior notice and the choice of whether to participate.

When Information We Collect May Be Disclosed to Third Parties

We disclose the personal or other information collected about you to third parties when (1) we have otherwise secured your permission to do so, or (2) in any of the following situations, with your permission based on this disclosure:

  • Service Provider Tracking
    Our service providers—including Google Analytics (Remarketing, Google Display Network Impression Reporting, the DoubleClick Campaign Manager Integration, and Google Analytics and Interest Reporting)—may use cookies and web beacons to collect non-Personally Identifiable Information about your activities on the Site and on other websites, to provide targeted advertising to you based on your interests.
    This means that these service providers may show our ads on sites across the internet based on your previous visits to our Site. Together with our service providers, we may use these cookies and web beacons to report how your ad impressions, other uses of ad services, and interactions with these ad impressions and ad services are related to your visits to our Site.

    And if you do not want this information used for the purpose of serving you targeted ads, you may . But please note that this will not opt you out of being served advertising—you will continue to receive generic ads.
    And if you delete your cookies, use a different browser, or buy a new computer, you will need to renew your online display advertising opt-out choice.   • Ask a Lawyer Forum
    The Site includes our public Ask a Lawyer forum in which consumer-users may post questions and lawyer-users may post answers. Any information you provide in the Ask a Lawyer forum may be read, collected, used, and distributed by others who access the forum, including members of the public who are not registered users of the Site. Please use caution when deciding whether to disclose your Personally Identifiable Information in these areas of the Site.
    To request removal of your Personally Identifiable Information from our Ask a Lawyer forum, contact us at privacy@LegalFix.com. In some instances, we may not, or may not be able to remove or change certain information, even if your account is closed. For example, we may retain and continue to display any information you provided in connection with a question, answer, testimonial, recommendation, status or performance indicator, rating, or ranking.

  • Service Providers and Organizations
    We may disclose the information collected about you to our service providers and other select organizations in connection with their performance of services or other activities in support of the Site and our businesses, or their completing or confirming on our behalf a transaction or series of transactions that you conduct with us.
    And if you access the LegalFix Services through a registration administered by your law school, public law library, or legal aid organization, your Personally Identifiable Information, non-Personally Identifiable Information, and certain usage data gathered through the LegalFix Services may be accessed by or shared with the administrator(s) authorized by the organization for the purposes of usage analysis; account management and compliance; evaluating course value; evaluating performance; and cost attribution and budgeting.

  • Blogs and Forums. The Site may include a publicly-accessible blog, discussion forums, question-and-answer forums, and other interactive forums. Any information you provide in these areas of the Site may be read, collected, used, and distributed by others who access them. Please use caution when deciding whether to disclose your Personally Identifiable Information in these areas of the Site. To request removal of your Personally Identifiable Information from our community forums, contact us at support@LegalFix.com. In some instances, we may not, or may not be able to remove or change certain information, even if your account is closed. For example, we may retain and continue to display any information you provided in connection with a question, answer, testimonial, review, status or performance indicator, rating, or ranking.

  • User Demographics
    We may disclose the results of aggregated data about you and other users of the Site without restriction. In these situations, we do not disclose to these entities any information that could be used to personally identify you.

  • Merger of Acquisition.
    We may disclose to one or more third parties the information collected about you as part of a potential or complete merger, acquisition, or other sale or transfer of any of the assets, stock, equity, ownership, or business of LegalFix, or any of our affiliates. Please note that the entity receiving such information in connection with one of these transactions may not comply with all the terms of this Privacy Policy.

  • Required by Law.
    We may disclose information about you to the government or to other third parties to comply with the law, applicable regulations, governmental and quasi-governmental requests, court orders, and subpoenas or other legal process, such as in connection with suspected illegal activity directed at the Site or our business. We reserve the right to release information collected through the Site to law enforcement or other government officials, as we determine to be necessary or appropriate.

  • Enforcement of Site Terms and Security.
    We may also disclose information about you to third parties if needed to enforce any of the Terms of Service or other agreements for the Site, or any investigation of potential violations of those agreements; to detect, prevent, or otherwise address fraud, security, or technical issues; to protect against harm to the Site; or to protect our rights, property, or safety, or the rights, property, or safety of our users or others (for example, to a consumer reporting agency for fraud protection).

Security Measures For Information We Collect

To help protect the privacy of information we collect, we employ security measures that are intended to be consistent with industry best practices. In storing such information, we take commercially reasonable steps intended to protect the data against unauthorized access.

But please be aware that the Site is operated on software, hardware, and networks, and any component may experience breaches of security or other problems beyond our control that may compromise the security of information collected about you.

Please also be aware that despite our best intentions and the guidelines outlined in this Privacy Policy, no data transmission over the internet or via a Wi-Fi network, or any encryption method, can be guaranteed to be completely secure. Thus, it may be possible for third parties not under our control to intercept or access your personal information transmitted through the Site, by e-mail, chat messaging, or other means.

We take commercially reasonable steps to protect the security and integrity of all information you provide through the Site, but due to the inherent nature of the internet, we cannot guarantee that any such information will be absolutely safe from intrusion by others who do not have your authorization. Any such transmission of your personal or other information is at your own risk.

How to Correct or Update Information We Have Collected About You

You may correct or update information we have collected about you by editing your account information on the Site, or for other information, by sending an e-mail with your request to privacy@LegalFix.com. You may also unsubscribe from any e-mail subscriptions by following the applicable Unsubscribe link or making the changes on your Account Management page. We will use commercially reasonable efforts to update our files to reflect your request as promptly as possible.

We may retain original and updated information for reasons such as technical constraints, dispute resolution, compliance with laws, fraud prevention, troubleshooting, and enforcement of our Terms of Service and other agreements. Also, please note that we cannot update any information about you collected through the Site that has already been disclosed (as permitted under this Privacy Policy) to a third party.

How We Respond to Do Not Track Signals

The Site does not currently support Do Not Track preferences that may be available in your browser for letting websites know that you do not want them collecting certain kinds of information. Specifically, if you turn on the Do Not Track setting on your browser, the Site is not currently capable of following whatever Do Not Track preferences you set. Transfer of Data from Outside the United States

If you use the Site from outside the United States, information that we collect about you through the Site will be transferred to servers inside the United States and maintained indefinitely. By using the Site, you consent to the transfer of data into the United States, and the processing of such data in the United States.

Children

The Site is not designed to appeal to persons under 13 years of age (children). We do not knowingly collect or maintain Personally Identifiable Information from children through the Site. If we learn that any unauthorized Personally Identifiable Information of a child has been collected, we will take appropriate steps to delete such PII.

If you are a parent or guardian and discover that your child has provided any such Personally Identifiable Information to us, you may contact us at privacy@LegalFix.com and request that we delete that PII from our systems.

Privacy Policies of any Linked Websites or Social Media

This Privacy Policy only addresses our practices for the personal and other information that we may obtain about you through the Site, or through your other communications with us. Please be aware that when you use or access the Site, you may be directed to other websites that are beyond our control, and we are not responsible for the privacy practices of third parties, or the content of linked websites.

Similarly, other websites may link to the Site. We would expect that most, if not all of these third parties will collect information about you when you use their offerings. But we are not responsible for the privacy practices of third parties, regardless of whether they are linked or otherwise connected to the Site.

We encourage you to read the posted privacy policy and terms of use whenever interacting with any third-party website, app, or other offering to confirm that you understand and agree with those policies and their terms.

The Site may also include social media features, such as the Facebook “like” button; the LinkedIn “like” button; and “share this” buttons or interactive mini-programs that run on our Site and allow you to share certain content, feedback, and information on Facebook, LinkedIn, Twitter, and other platforms.

These features may collect your IP address and which page you are visiting on our Site and may set a cookie to allow the feature to function properly. Such social media features and widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these features are governed by the privacy policy of the company providing it.

Governing Law, Jurisdiction, and Dispute Resolution

The Site (excluding any linked sites) is controlled by LegalFix from our offices within the state of Texas, in the United States of America. It can be accessed from all 50 states, as well as from other countries around the world.

As each of these places has laws that may differ from those of Texas, by accessing or attempting to access the Site, you and LegalFix agree that any claim, cause of action, or dispute between you and LegalFix will be governed by and construed under the statutes and laws of the state of Texas, without regard to conflict-of-laws rules and the United Nations Convention on the International Sales of Goods.

This includes, for example, any claim, cause of action, or dispute relating to your use or attempted use of the Site; your interactions and communications with LegalFix; LegalFix’s collection, use, and disclosure of your personal or other information; and your privacy, whether such claims are based in contract, tort, statute, equity, or other legal basis. You and LegalFix agree and submit to the exclusive personal jurisdiction of any court of competent jurisdiction within the state of Texas with respect to such matters.

You also agree that all claims, causes of action, and disputes between you and LegalFix are governed by the dispute resolution provisions in the Terms of Service and other agreements applicable to the Site, including the provisions for binding arbitration, waiver of the right to a jury trial, and waiver of the right to participate in a class, consolidated, or representative action.

By using or attempting to use the Site, you also agree to the limitation of liability provision in the Terms of Service and other agreements applicable to the Site for any and all claims, causes of action, and disputes between you and LegalFix, including for any claims, causes of action, or disputes related to your privacy, our use of your personal or other information collected through the Site or otherwise, and the issues addressed in this Privacy Policy.

Changes to this Privacy Policy
